These Website Terms of Use (the “Website Terms”) govern your access to and use of the hypena.com websites and any subdomains, mobile sites, and embedded interfaces operated by Hypena (collectively, the “Website”). By accessing the Website, you agree to these Website Terms.
Use of the Hypena marketplace itself (placing orders, listing services, sending messages, etc.) is additionally governed by the Buyer Terms and the Vendor Agreement.
1. Role of the Website
The Website provides a digital venue connecting buyers with independent print-shop vendors. Hypena does not produce printed goods, does not warrant the work of any vendor, and is not a party to any contract formed between a buyer and a vendor.
2. Disclaimers
To the maximum extent permitted by applicable law, the Website is provided on an “as is” and “as available” basis. Hypena makes no representations or warranties about:
- The quality, safety, legality, fitness for purpose, or merchantability of any printed goods or services offered by vendors.
- The truth, completeness, or accuracy of listings, vendor descriptions, or user-generated reviews.
- The continuous availability of the Website. Technical maintenance, third-party outages, or force-majeure events may cause interruptions; Hypena will not be liable for loss of business or other consequential losses arising from downtime.
- The conduct of any user, vendor, or third party (including their compliance with applicable laws).
3. Acceptable Use
- Do not scrape, crawl, or extract data from the Website by automated means without our prior written permission.
- Do not attempt to disrupt, probe, or circumvent the security or operation of the Website.
- Do not impersonate any person or misrepresent your affiliation with any entity.
- Do not use the Website to transmit malicious code, phishing content, or unsolicited commercial communications.
4. Intellectual Property
The Website — including its source code, design, copy, logos, and the Hypena name — is owned by Hypena or its licensors and is protected by intellectual-property laws. You receive only a limited, revocable, non-transferable licence to use the Website for its intended purpose. Vendor and buyer-generated content (artwork, listings, reviews) remains the property of its respective owner.
5. Reporting Infringement
If you believe content on the Website infringes your rights, send a complete notice to [email protected] including: identification of the work claimed to be infringed, the location of the material on the Website, your contact details, a good-faith statement that the use is unauthorised, and a statement under penalty of perjury that the information is accurate. We will respond promptly and may remove or disable access to the material pending resolution.
6. Third-Party Links
The Website may contain links to third-party sites. Those sites are not controlled by Hypena, and Hypena is not responsible for their content, privacy practices, or terms.
7. Limitation of Liability
To the maximum extent permitted by law, Hypena will not be liable for any indirect, incidental, special, consequential, or exemplary damages (including loss of profits, revenue, data, or business opportunity) arising out of or related to your use of the Website. Hypena’s aggregate liability for any direct damages will not exceed the greater of (a) USD 100 (or its equivalent in the currency in which you transacted), or (b) the amount of fees Hypena has actually received from you in the 12 months preceding the event giving rise to the claim.
8. Indemnification
You agree to indemnify and hold harmless Hypena and its officers, employees, and affiliates against any claims arising from your breach of these Website Terms, your misuse of the Website, or your violation of applicable law or the rights of a third party.

Hypena may modify these Website Terms at any time by posting the updated version on this page. Material changes will be announced via banner, email, or in-app notice at least 14 days before they take effect. Continued use of the Website constitutes acceptance.
10. Governing Law & Venue
These Website Terms are governed by the laws of the Republic of Armenia, without regard to its conflict-of-laws principles, and the competent courts of Yerevan, Republic of Armenia have exclusive jurisdiction over any dispute arising under them. If you are a consumer, this does not deprive you of the protection of any mandatory rules of the country in which you have your habitual residence.
